A Penticton city council member facing historical sexual offense allegations involving minors attended a trial in Sarnia, Ontario. James Miller, 60, was elected in a 2021 by-election and is currently on leave from his council duties. The charges against him include three counts of sexual interference, two counts of inviting sexual touching, and one count of sexual assault of a person under 16 years old.

Testimony in court came from one of the three accusers, who stated he met Miller while in Grade 5 or 6 at a Sarnia school where Miller coached basketball as a volunteer. The witness mentioned that Miller would often offer players rides home and invite them to his apartment, creating a sense of comfort and trust. Subsequently, the accuser spent more time alone with Miller, leading to incidents involving inappropriate behavior such as foot massages and sexual touching.

The accuser expressed fear of speaking out due to concerns about losing privileges and opportunities provided by Miller, whom he considered a trusted friend and mentor. The emotional impact of the alleged offenses was evident as the accuser described strained relationships and emotional turmoil.

During cross-examination, Miller’s defense questioned the accuser’s timeline and interactions with Miller after the alleged incidents. The defense highlighted inconsistencies in the accuser’s statements, including references to events that seemed implausible based on historical facts.

The trial, presided over by a judge, is ongoing and is expected to last five weeks.
