“N.W.T. SPCA Pushes for Recognition of Animals as Sentient Beings”

The N.W.T. SPCA urges the territorial government to consider legally recognizing domestic animals as sentient beings rather than mere property. The current Dog Act in the Northwest Territories dictates that dogs are considered the property of their owners. This legislation restricts authorities from intervening effectively in cases concerning animal welfare, leading to concerns raised by both residents and tourists over the treatment of animals in the region.

Nicole Spencer, the executive director of the N.W.T. SPCA, highlighted the disconnect between existing laws and evolving expectations regarding animal care. While the legislation sets basic standards like food, water, and shelter, it may not adequately address more complex welfare issues.

Toronto-based animal welfare lawyer Jennifer Friedman noted that pets are commonly viewed as property, or chattel, in various Canadian jurisdictions, including Ontario. However, some provinces, like British Columbia in 2024, are taking steps to broaden the criteria used in family disputes involving pets.

The Department of Municipal and Community Affairs, responsible for administering the Dog Act, currently has no plans to revise the legislation. Minister Vince McKay emphasized that the act serves as a foundational document for municipalities to tailor their approach to animal care. McKay acknowledged the need for potential updates but stressed the importance of balancing legislative priorities when considering amendments to the Dog Act.
