“Hollywood Mogul Harvey Weinstein Faces Third Trial”

Harvey Weinstein, the former Hollywood mogul, is set to return to court in New York for his third trial on charges of rape and sexual assault. Alongside his brother Bob Weinstein, Harvey co-ran Miramax, a prominent production company known for its influence during awards seasons and Harvey’s reputation as a demanding leader. However, after the emergence of the #MeToo movement in 2017, multiple women accused him of sexual misconduct. 

Following public allegations reported in the New York Times and New Yorker, Weinstein was fired from his company, expelled from the Academy of Motion Picture Arts and Sciences, and later criminally charged in 2018. Despite his consistent denial of any wrongdoing and claims of consensual interactions, he did not testify in any of his trials.  

Since his initial conviction in 2020 for third-degree rape and first-degree criminal sexual act involving Jessica Mann and Miriam Haley respectively, Weinstein has been in prison. Despite being acquitted on three other charges, including predatory sexual assault, he started serving a 23-year sentence at Rikers Island in 2020 while facing additional charges in Los Angeles. 

In 2022, he was found guilty of the Los Angeles charges, receiving a 16-year sentence, to be served after completing his New York term. However, in 2024, a New York appeals court overturned his 2020 convictions due to legal errors related to witness testimonies. 

At a subsequent retrial in 2025, charges related to Miriam Haley were upheld, but the jury could not reach a verdict on the charge of third-degree rape involving Jessica Mann. 

New Allegations

Jessica Mann testified about her relationship with Weinstein, claiming that despite initially consenting, she later felt pressured and eventually gave in to his advances. Additionally, Kaja Sokola, a third accuser, alleged sexual assault during the 2025 trial, but Weinstein was acquitted of this charge. 

As the new trial unfolds, Weinstein is appealing the Los Angeles verdict and is expected to challenge the New York conviction concerning Miriam Haley. The potential sentence for the latter case could amount to 25 years in prison, with the retrial anticipated to last over a month. 

Jury selection for the upcoming trial began with over 80 individuals excusing themselves due to the case’s extensive coverage and asked if they could remain impartial. Prosecutors revealed a new piece of evidence, a statement allegedly made by Weinstein during his 2020 conviction, which his defense team contested as unfounded and untimely. 

Weinstein’s legal team, now led by Marc Agnifilo, has been handling his defense since 2022, emphasizing his health issues and the toll his incarceration has taken on him. Weinstein, aged 73, has faced various health challenges, including cancer and emergency heart surgery, while expressing deteriorating mental well-being during his time at Rikers Island.
