ABC has taken legal action against the Federal Communications Commission (FCC) over concerns that the agency’s demand for early review of broadcast licenses poses a significant threat to its operations. The lawsuit, filed by ABC and its parent company Disney, along with eight local stations affected by the review, seeks to halt the early renewal proceedings initiated by FCC Chairman Brendan Carr, a supporter of President Donald Trump.

The FCC’s decision to review the licenses, well before their expiration dates, was prompted by concerns regarding the network’s diversity practices. However, the timing of this move followed a controversial joke made by ABC’s late-night host Jimmy Kimmel, known for his critical stance against Trump.

In response to what ABC perceives as an attack on its freedom of speech, the network alleged that the administration’s actions could lead to the revocation of its broadcast licenses. The lawsuit aims to prevent any adverse actions by the FCC and seeks judicial intervention to protect ABC’s First Amendment rights.

This legal battle is just one aspect of a broader conflict between ABC and the FCC, with ongoing disputes over regulatory issues such as equal-time rules for programs like “The View.” The lawsuit emphasizes that the implications of the administration’s actions extend beyond ABC, warning of a chilling effect on media companies nationwide.

Anna Gomez, the sole Democrat on the FCC, praised ABC and Disney for challenging the agency’s actions, characterizing them as attempts to stifle free speech. Meanwhile, FCC Chairman Carr defended the agency’s stance, emphasizing broadcasters’ responsibility to serve the public interest.

The FCC reiterated its commitment to ensuring broadcasters operate in the public interest, citing ongoing investigations into claims of diversity discrimination by Disney. The commission vowed to continue examining the matter despite the legal challenge from ABC.
