Additionally, there were concerns about pending trials involving allegations of sexual assault and child pornography.
Despite a provincial government briefing note from 2024 suggesting a decline in Jordan applications, CBC’s independent investigation indicated that the issue persists. One notable case involved a pregnant woman testifying about being threatened and assaulted by her former partner. The trial was halted due to exceeding time limits, leading to the accused being released.
The R v Jordan decision by the Supreme Court of Canada, made a decade ago, aimed to address delays in the justice system. It established timeframes for completing trials to prevent prolonged uncertainty for both accused individuals and victims. The decision highlighted the detrimental impact of delays on all parties involved in legal proceedings.
The investigation also uncovered instances where Crown prosecutors successfully opposed Jordan applications, leading to the dismissal of charges. Additionally, plea deals were struck in some cases to resolve legal matters efficiently. While data tracking the outcomes of Jordan applications is lacking at the provincial level, Statistics Canada data indicated a rise in cases exceeding Jordan limits in recent years. This increase underscores the ongoing challenges faced by the justice system in meeting trial deadlines and ensuring timely resolution of legal cases.
