In a recent court ruling, a Burlington, Ontario couple has been found guilty of murder and other charges relating to the abuse of two brothers under their care. Justice Clayton Conlan emphasized that Becky Hamber and Brandy Cooney were solely responsible for the crimes, indicating that the actions or inactions of the Children’s Aid Society (CAS) played no role in their guilt.
Despite this, the case has raised concerns about the child protection system, drawing attention to underlying systemic issues that require immediate attention. Sherry Saevil, a member of Circle of Beads, an Indigenous advocacy group in the Halton region, expressed a desire for a better future for children following the tragic events.
The trial revealed that the brothers, L.L. and J.L., had entered the child protection system when the older boy was a toddler due to undisclosed concerns about their home environment. Although they were under the care of Cooney and Hamber in Burlington, the Ottawa CAS retained guardianship, with the Halton CAS responsible for daily supervision.
Reports of mistreatment by Hamber and Cooney were allegedly ignored by the Halton CAS, despite numerous concerns raised by individuals. Following L.L.’s death, both CAS agencies conducted reviews and implemented undisclosed changes. However, they declined to comment on the recent court ruling.
Advocates, including Saevil and Cheyanne Ratnam, have called for reforms in the child welfare system to prevent further tragedies. They emphasize the importance of implementing recommendations outlined by the Truth and Reconciliation Commission, particularly regarding Indigenous child welfare.
The death of L.L. has been described as a result of “catastrophic failures” within the child protection system, prompting demands for an inquest to investigate the role of CAS agencies. Irwin Elman highlighted the need for transparency and accountability in addressing systemic failures.
As efforts continue to seek justice for the victims and improve child welfare services, the case serves as a stark reminder of the importance of safeguarding vulnerable children. Ontario’s political opposition has urged the government to take immediate action to enhance child welfare and social services systems.
