In a statement conveyed to CBC News through her legal representation, Tenisha Warner expressed her efforts to privately settle her late husband’s complex estate while upholding his final wishes concerning their daughter, MacKenzie. She emphasized Malcolm’s intent to provide for their daughter and herself, acknowledging the challenges she has faced as a single mother and sole provider. Tenisha Warner stated that legal action was necessary to safeguard their rights before any potential statute of limitations expired.
The legal dispute centers on a trust established in 1996, predating Malcolm-Jamal Warner’s relationship with Tenisha and the birth of their daughter. The trust currently designates 100% of its assets to other family members, primarily Pamela Warner, as well as his father and half-sister. Allegations in the court documents claim that funds from life insurance and retirement accounts exceeding $1.25 million US have already been distributed to these beneficiaries.
Tenisha Warner’s petition outlines various financial obligations that Malcolm-Jamal Warner allegedly failed to fulfill before his demise. She is seeking at least $1,276,042.46 US, excluding interest, legal fees, and expenses. The petition requests the court to acknowledge her and their daughter as omitted heirs and spouses, halt trust disbursements during the legal proceedings, and provide a comprehensive financial report. The financial obligations include a term life insurance policy, anniversary gift provisions, Roth IRA contributions, and salary commitments.
