“Report Exposes Challenges Faced by Sexual Violence Survivors”

A recent report by Canada’s victims of crime advocate reveals that survivors of sexual violence encounter significant challenges within the criminal justice system. The report, titled “Rethinking Justice for Survivors of Sexual Violence: A Systemic Investigation,” presents findings based on over 3,000 interviews, surveys, and case reviews conducted since March 2024.

According to Benjamin Roebuck, the federal ombudsperson for victims of crime, victims of sexual violence often face disbelief in their allegations and experience delays or dismissals of their cases. The report highlights systemic issues across the justice system that deter victims from coming forward and potentially re-traumatize them if they do.

Roebuck emphasized the need for significant changes to protect survivors better and restore trust in the justice system. Among the report’s 43 recommendations, the call to thoroughly investigate sexual violence allegations reported to the police stands out as crucial in addressing the prevailing challenges.

Furthermore, the report urges specific training for law enforcement and courts to cater to the unique needs of sexual assault survivors based on various factors such as sex, gender, age, and cultural background. It also recommends discontinuing the use of “KGB statements” and enhancing justice for Indigenous communities by implementing the calls for justice from the National Inquiry into Missing and Murdered Indigenous Women and Girls.

Addressing delays in court proceedings, the report suggests amending the Criminal Code to establish criteria for considering stays in cases exceeding specified time limits. Additionally, it advocates for a fair cross-examination process that respects the privacy and mental well-being of survivors, including limiting access to therapy records by defense attorneys.

The report underscores the importance of providing testimonial aids and expanding restorative justice programs while advocating for better support for sexual assault survivors at the community level. It also emphasizes the need for enhanced data collection to assess the effectiveness of interventions and the responsiveness of the criminal justice system to cases of sexual violence.
